Welcome to Maliba Entertainment's services, including but not limited to our games, applications, and websites (collectively, the "Services"). By accessing or using any of our Services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.

1. Acceptance of Terms

1.1. By using our Services, you affirm that you are at least 10 years old and meet any other eligibility requirements of your jurisdiction.

1.2. If you are between 10 and 18 years old, you represent that your legal guardian has reviewed and agreed to these Terms.

1.3. You acknowledge that these Terms constitute a binding agreement between you and Maliba Entertainment ("we," "us," or "our").

2. License and Use of Services

2.1. We grant you a limited, non-exclusive, non-transferable, revocable license to use our Services for your personal, non-commercial entertainment purposes.

2.2. You agree not to:

• a) Copy, distribute, or reproduce our Services in any way
• b) Modify, adapt, translate, reverse engineer, decompile, or disassemble our Services
• c) Create derivative works based on our Services
• d) Remove any proprietary notices or labels on our Services
• e) Use our Services for any commercial purpose without our express written consent

3. User Accounts

3.1. Some Services may require you to create an account. You are responsible for maintaining the confidentiality of your account information.

3.2. You agree to provide accurate and complete information when creating your account and to update this information as necessary.

3.3. You are solely responsible for all activities that occur under your account.

3.4. We reserve the right to terminate or suspend your account at any time for any reason, including violation of these Terms.

4. In-App Purchases and Virtual Items

4.1. Our Services may offer the opportunity to purchase virtual items or currency ("Virtual Items") for use within the Services.

4.2. Virtual Items are licensed to you and do not constitute property. You acknowledge that you do not own these Virtual Items and that your license to use them is limited and revocable.

4.3. There are two types of Virtual Item purchases:

• a) Immediate Consumption: These items are granted to you immediately upon purchase and are consumed or used within the Service. Once used, they cannot be refunded or transferred.
• b) Account-Bound: These items are permanently associated with your account and remain available for your use as long as your account is active and in good standing.

4.4. In-app purchases are final and non-refundable, except as required by applicable law.

4.5. Parents and guardians are responsible for any in-app purchases made by minors using their account.

5. User Conduct

5.1. You agree to use our Services in compliance with all applicable laws and regulations.

5.2. You will not engage in any of the following prohibited activities:

• a) Cheating, using exploits, or manipulating game mechanics
• b) Harassing, bullying, or intimidating other users
• c) Impersonating other users or Maliba Entertainment staff
• d) Sharing personal information of others without their consent
• e) Any activity that disrupts the normal functioning of our Services
• f) Uploading or transmitting any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable

6. Modding and Third-Party Software

6.1. Modding of any kind is STRICTLY PROHIBITED. This includes but is not limited to:

• a) Altering game files or application data
• b) Creating or using custom content not officially supported by our Services
• c) Using third-party software to modify gameplay, assets, or functionality

6.2. Use of any unauthorized third-party software, including but not limited to cheats, bots, or hacks, is expressly forbidden.

6.3. Violation of these modding and third-party software restrictions may result in immediate termination of your license to use our Services.

7. Virtual Reality Safety (where applicable)

7.1. For VR Services, you acknowledge that use of virtual reality equipment carries inherent risks, including potential physical injury, discomfort, or motion sickness.

7.2. You agree to:

• a) Follow all safety guidelines provided with your VR equipment
• b) Ensure your play area is clear of obstacles
• c) Take regular breaks to avoid extended periods of VR use
• d) Discontinue use if you experience any discomfort or adverse effects

7.3. Maliba Entertainment is not responsible for any injuries or damages resulting from your use of VR equipment while using our Services.

8. Age Requirements and Restrictions

8.1. In compliance with Meta's requirements and other applicable regulations:

• a) Users must be at least 10 years old to use our Services.
• b) Users between 10 and 13 years old may be subject to additional restrictions or require parental consent for certain features.
• c) Some Services or content may have higher age restrictions, which will be clearly indicated.

8.2. We reserve the right to verify your age and to restrict or terminate access if we have reason to believe you do not meet the age requirements.

9. Intellectual Property

9.1. All intellectual property rights in our Services, including but not limited to copyrights, trademarks, and trade secrets, are owned by Maliba Entertainment or our licensors.

9.2. You agree not to use, copy, or distribute any content from our Services without our express written permission.

10. User Content

10.1. Some Services may allow you to submit or upload content ("User Content"). You retain ownership of your User Content.

10.2. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your User Content in any existing or future media.

10.3. You represent and warrant that your User Content does not violate any third-party rights and complies with these Terms.

11. Privacy

11.1. Your use of our Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

12. Updates and Modifications

12.1. We reserve the right to update, modify, or discontinue any of our Services at any time without notice.

12.2. We may also update these Terms from time to time. Continued use of our Services after any such changes constitutes your acceptance of the new Terms.

13. Termination

13.1. We reserve the right to terminate or suspend your access to our Services at any time, without notice, for any reason, including violation of these Terms.

14. Disclaimer of Warranties

14.1. OUR SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.

14.2. We do not guarantee that our Services will be uninterrupted, secure, or error-free.

15. Limitation of Liability

15.1. TO THE MAXIMUM EXTENT PERMITTED BY LAW, MALIBA ENTERTAINMENT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES.

16. Governing Law and Dispute Resolution

16.1. These Terms shall be governed by and construed in accordance with the laws of Israel, without regard to its conflict of law provisions.

16.2. Any disputes arising from or relating to these Terms or our Services will be resolved through binding arbitration, except where prohibited by law.
